1 And the LORD spake unto Moses in the plains of Moab by Jordan near Jericho, saying,
2 Command the children of Israel, that they give unto the Levites of the inheritance of their possession cities to dwell in; and ye shall give also unto the Levites suburbs for the cities round about them.
3 And the cities shall they have to dwell in; and the suburbs of them shall be for their cattle, and for their goods, and for all their beasts.
4 And the suburbs of the cities, which ye shall give unto the Levites, shall reach from the wall of the city and outward a thousand cubits round about.
5 And ye shall measure from without the city on the east side two thousand cubits, and on the south side two thousand cubits, and on the west side two thousand cubits, and on the north side two thousand cubits; and the city shall be in the midst: this shall be to them the suburbs of the cities.
6 And among the cities which ye shall give unto the Levites there shall be six cities for refuge, which ye shall appoint for the manslayer, that he may flee thither: and to them ye shall add forty and two cities.
7 So all the cities which ye shall give to the Levites shall be forty and eight cities: them shall ye give with their suburbs.
8 And the cities which ye shall give shall be of the possession of the children of Israel: from them that have many ye shall give many; but from them that have few ye shall give few: every one shall give of his cities unto the Levites according to his inheritance which he inheriteth.
9 And the LORD spake unto Moses, saying,
10 Speak unto the children of Israel, and say unto them, When ye be come over Jordan into the land of Canaan;
11 Then ye shall appoint you cities to be cities of refuge for you; that the slayer may flee thither, which killeth any person at unawares.
12 And they shall be unto you cities for refuge from the avenger; that the manslayer die not, until he stand before the congregation in judgment.
13 And of these cities which ye shall give six cities shall ye have for refuge.
14 Ye shall give three cities on this side Jordan, and three cities shall ye give in the land of Canaan, which shall be cities of refuge.
15 These six cities shall be a refuge, both for the children of Israel, and for the stranger, and for the sojourner among them: that every one that killeth any person unawares may flee thither.
16 And if he smite him with an instrument of iron, so that he die, he is a murderer: the murderer shall surely be put to death.
17 And if he smite him with throwing a stone, wherewith he may die, and he die, he is a murderer: the murderer shall surely be put to death.
18 Or if he smite him with an hand weapon of wood, wherewith he may die, and he die, he is a murderer: the murderer shall surely be put to death.
19 The revenger of blood himself shall slay the murderer: when he meeteth him, he shall slay him.
20 But if he thrust him of hatred, or hurl at him by laying of wait, that he die;
21 Or in enmity smite him with his hand, that he die: he that smote him shall surely be put to death; for he is a murderer: the revenger of blood shall slay the murderer, when he meeteth him.
22 But if he thrust him suddenly without enmity, or have cast upon him any thing without laying of wait,
23 Or with any stone, wherewith a man may die, seeing him not, and cast it upon him, that he die, and was not his enemy, neither sought his harm:
24 Then the congregation shall judge between the slayer and the revenger of blood according to these judgments:
25 And the congregation shall deliver the slayer out of the hand of the revenger of blood, and the congregation shall restore him to the city of his refuge, whither he was fled: and he shall abide in it unto the death of the high priest, which was anointed with the holy oil.
26 But if the slayer shall at any time come without the border of the city of his refuge, whither he was fled;
27 And the revenger of blood find him without the borders of the city of his refuge, and the revenger of blood kill the slayer; he shall not be guilty of blood:
28 Because he should have remained in the city of his refuge until the death of the high priest: but after the death of the high priest the slayer shall return into the land of his possession.
29 So these things shall be for a statute of judgment unto you throughout your generations in all your dwellings.
30 Whoso killeth any person, the murderer shall be put to death by the mouth of witnesses: but one witness shall not testify against any person to cause him to die.
31 Moreover ye shall take no satisfaction for the life of a murderer, which is guilty of death: but he shall be surely put to death.
32 And ye shall take no satisfaction for him that is fled to the city of his refuge, that he should come again to dwell in the land, until the death of the priest.
33 So ye shall not pollute the land wherein ye are: for blood it defileth the land: and the land cannot be cleansed of the blood that is shed therein, but by the blood of him that shed it.
34 Defile not therefore the land which ye shall inhabit, wherein I dwell: for I the LORD dwell among the children of Israel.

19 The revenger H1350 of blood H1818 himself shall slay H4191 the murderer: H7523 when he meeteth H6293 him, he H1931 shall slay H4191 him.
20 But if he thrust H1920 him of hatred, H8135 or hurl H7993 at him by laying of wait, H6660 that he die; H4191
21 Or in enmity H342 smite H5221 him with his hand, H3027 that he die: H4191 he that smote H5221 him shall surely H4191 be put to death; H4191 for he is a murderer: H7523 the revenger H1350 of blood H1818 shall slay H4191 the murderer, H7523 when he meeteth H6293 him.
22 But if he thrust H1920 him suddenly H6621 without H3808 enmity, H342 or have cast H7993 upon him any thing H3627 without laying of wait, H6660
23 Or with any stone, H68 wherewith a man may die, H4191 seeing H7200 him not, H3808 and cast H5307 it upon him, that he die, H4191 and was not his enemy, H341 neither sought H1245 his harm: H7451
24 Then the congregation H5712 shall judge H8199 between the slayer H5221 and the revenger H1350 of blood H1818 according to these judgments: H4941
25 And the congregation H5712 shall deliver H5337 the slayer H7523 out of the hand H3027 of the revenger H1350 of blood, H1818 and the congregation H5712 shall restore H7725 him to the city H5892 of his refuge, H4733 whither he was fled: H5127 and he shall abide H3427 in it unto the death H4194 of the high H1419 priest, H3548 which was anointed H4886 with the holy H6944 oil. 26 But if the slayer H7523 shall at any time H3318 come H3318 without the border H1366 of the city H5892 of his refuge, H4733 whither he was fled; H5127
27 And the revenger H1350 of blood H1818 find H4672 him without H2351 the borders H1366 of the city H5892 of his refuge, H4733 and the revenger H1350 of blood H1818 kill H7523 the slayer; H7523 he shall not be guilty of blood: H1818
28 Because he should have remained H3427 in the city H5892 of his refuge H4733 until the death H4194 of the high H1419 priest: H3548 but after H310 the death H4194 of the high H1419 priest H3548 the slayer H7523 shall return H7725 into the land H776 of his possession. H272
29 So these things shall be for a statute H2708 of judgment H4941 unto you throughout your generations H1755 in all your dwellings. H4186
30 Whoso killeth H5221 any person, H5315 the murderer H7523 shall be put to death H7523 by the mouth H6310 of witnesses: H5707 but one H259 witness H5707 shall not testify H6030 against any person H5315 to cause him to die. H4191
31 Moreover ye shall take H3947 no satisfaction H3724 for the life H5315 of a murderer, H7523 which is guilty H7563 of death: H4191 but he shall be surely H4191 put to death. H4191
32 And ye shall take H3947 no satisfaction H3724 for him that is fled H5127 to the city H5892 of his refuge, H4733 that he should come again H7725 to dwell H3427 in the land, H776 until the death H4194 of the priest. H3548
33 So ye shall not pollute H2610 the land H776 wherein ye are: for blood H1818 it defileth H2610 the land: H776 and the land H776 cannot be cleansed H3722 of the blood H1818 that is shed H8210 therein, but by the blood H1818 of him that shed H8210 it.
34 Defile H2930 not therefore the land H776 which ye shall inhabit, H3427 wherein H8432 I dwell: H7931 for I the LORD H3068 dwell H7931 among H8432 the children H1121 of Israel. H3478

11 and have prepared to yourselves cities -- cities of refuge they are to you -- then fled thither hath a man-slayer, smiting a person unawares,
12 and the cities have been to you for a refuge from the redeemer, and the man-slayer doth not die till his standing before the company for judgment.
13 `As to the cities which ye give -- six `are' cities of refuge to you;
14 the three of the cities ye give beyond the Jordan, and the three of the cities ye give in the land of Canaan; cities of refuge they are.
15 To sons of Israel, and to a sojourner, and to a settler in their midst, are these six cities for a refuge, for the fleeing thither of any one smiting a person unawares.
16 `And if with an instrument of iron he hath smitten him, and he dieth, he `is' a murderer: the murderer is certainly put to death.
17 `And if with a stone `in' the hand, wherewith he dieth, he hath smitten him, and he dieth, he `is' a murderer: the murderer is certainly put to death.
18 `Or with a wooden instrument `in' the hand, wherewith he dieth, he hath smitten him, and he dieth, he `is' a murderer: the murderer is certainly put to death.
19 `The redeemer of blood himself doth put the murderer to death; in his coming against him he doth put him to death.
20 `And if in hatred he thrust him through, or hath cast `anything' at him by lying in wait, and he dieth;
21 or in enmity he hath smitten him with his hand, and he dieth; the smiter is certainly put to death; he `is' a murderer; the redeemer of blood doth put the murderer to death in his coming against him.
22 `And if, in an instant, without enmity, he hath thrust him through, or hath cast at him any instrument, without lying in wait;
23 or with any stone wherewith he dieth, without seeing, and causeth `it' to fall upon him, and he dieth, and he `is' not his enemy, nor seeking his evil;
24 then have the company judged between the smiter and the redeemer of blood, by these judgments.
25 `And the company have delivered the man-slayer out of the hand of the redeemer of blood, and the company have caused him to turn back unto the city of his refuge, whither he hath fled, and he hath dwelt in it till the death of the chief priest, who hath been anointed with the holy oil.
26 `And if the man-slayer at all go out `from' the border of the city of his refuge whither he fleeth,
27 and the redeemer of blood hath found him at the outside of the border of the city of his refuge, and the redeemer of blood hath slain the man-slayer, blood is not for him;
28 for in the city of his refuge he doth dwell till the death of the chief priest; and after the death of the chief priest doth the man-slayer turn back unto the city of his possession.
29 `And these things have been to you for a statute of judgment to your generations, in all your dwellings:
30 whoso smiteth a person, by the mouth of witnesses doth `one' slay the murderer; and one witness doth not testify against a person -- to die.
31 `And ye take no atonement for the life of a murderer who `is' condemned -- to die, for he is certainly put to death;
32 and ye take no atonement for him to flee unto the city of his refuge, to turn back to dwell in the land, until the death of the priest.
33 `And ye profane not the land which ye `are' in, for blood profaneth the land; as to the land, it is not pardoned for blood which is shed in it except by the blood of him who sheddeth it;
34 and ye defile not the land in which ye are dwelling, in the midst of which I do tabernacle, for I Jehovah do tabernacle in the midst of the sons of Israel.'

23 or [have smitten him] with any stone wherewith one may die, without seeing him, and have cast it upon him so that he die, and he was not his enemy, neither sought his harm:
24 then the assembly shall judge between the smiter and the avenger of blood according to these judgments;
25 and the assembly shall rescue the manslayer out of the hand of the avenger of blood, and the assembly shall restore him to the city of his refuge, whither he had fled; and he shall abide in it until the death of the high-priest, who was anointed with the holy oil.
26 But if the manslayer shall in any way come outside the limits of the city of his refuge whither he hath fled,
27 and the avenger of blood find him outside the limits of his city of refuge, and the avenger of blood kill the manslayer, there shall be no blood-guiltiness upon him;
28 for the manslayer should have remained in the city of his refuge until the death of the high-priest; but after the death of the high-priest he may return into the land of his possession.
29 And this shall be unto you a statute of right throughout your generations in all your dwellings.
30 Whoever shall smite a person mortally, at the mouth of witnesses shall the murderer be put to death; but one witness shall not testify against a person to cause him to die.

6 The cities which you shall give to the Levites, they shall be the six cities of refuge, which you shall give for the manslayer to flee to: and besides them you shall give forty-two cities.
7 All the cities which you shall give to the Levites shall be forty-eight cities; them [shall you give] with their suburbs.
8 Concerning the cities which you shall give of the possession of the children of Israel, from the many you shall take many; and from the few you shall take few: everyone according to his inheritance which he inherits shall give of his cities to the Levites.
9 Yahweh spoke to Moses, saying,
10 Speak to the children of Israel, and tell them, When you pass over the Jordan into the land of Canaan,
11 then you shall appoint you cities to be cities of refuge for you, that the manslayer who kills any person unwittingly may flee there.
12 The cities shall be to you for refuge from the avenger, that the manslayer not die, until he stands before the congregation for judgment.
13 The cities which you shall give shall be for you six cities of refuge.
14 You shall give three cities beyond the Jordan, and three cities shall you give in the land of Canaan; they shall be cities of refuge.
15 For the children of Israel, and for the stranger and for the foreigner living among them, shall these six cities be for refuge; that everyone who kills any person unwittingly may flee there.
16 But if he struck him with an instrument of iron, so that he died, he is a murderer: the murderer shall surely be put to death.
17 If he struck him with a stone in the hand, by which a man may die, and he died, he is a murderer: the murderer shall surely be put to death.
18 Or if he struck him with a weapon of wood in the hand, by which a man may die, and he died, he is a murderer: the murderer shall surely be put to death.
19 The avenger of blood shall himself put the murderer to death: when he meets him, he shall put him to death.
20 If he thrust him of hatred, or hurled at him, lying in wait, so that he died,
21 or in enmity struck him with his hand, so that he died; he who struck him shall surely be put to death; he is a murderer: the avenger of blood shall put the murderer to death, when he meets him.
22 But if he thrust him suddenly without enmity, or hurled on him anything without lying in wait,
23 or with any stone, by which a man may die, not seeing him, and cast it on him, so that he died, and he was not his enemy, neither sought his harm;
24 then the congregation shall judge between the striker and the avenger of blood according to these ordinances;
25 and the congregation shall deliver the manslayer out of the hand of the avenger of blood, and the congregation shall restore him to his city of refuge, where he was fled: and he shall dwell therein until the death of the high priest, who was anointed with the holy oil.
26 But if the manslayer shall at any time go beyond the border of his city of refuge, where he flees,
27 and the avenger of blood find him outside of the border of his city of refuge, and the avenger of blood kill the manslayer; he shall not be guilty of blood,
28 because he should have remained in his city of refuge until the death of the high priest: but after the death of the high priest the manslayer shall return into the land of his possession.
29 These things shall be for a statute [and] ordinance to you throughout your generations in all your dwellings.
30 Whoever kills any person, the murderer shall be slain at the mouth of witnesses: but one witness shall not testify against any person that he die.
31 Moreover you shall take no ransom for the life of a murderer who is guilty of death; but he shall surely be put to death.
32 You shall take no ransom for him who is fled to his city of refuge, that he may come again to dwell in the land, until the death of the priest.
33 So you shall not pollute the land in which you are: for blood, it pollutes the land; and no expiation can be made for the land for the blood that is shed therein, but by the blood of him who shed it.
34 You shall not defile the land which you inhabit, in the midst of which I dwell: for I, Yahweh, dwell in the midst of the children of Israel.
1 And the Lord said to Moses in the lowlands of Moab by Jordan at Jericho,
2 Give orders to the children of Israel to give to the Levites, from the heritage which is theirs, towns for themselves, with land on the outskirts of the towns.
3 These towns are to be their living-places, with land round them for their cattle and their food and all their beasts,
4 Stretching from the wall of the towns a distance of a thousand cubits all round.
5 The measure of this space of land is to be two thousand cubits outside the town on the east, and two thousand cubits on the south and on the west and on the north, the town being in the middle. This space will be the outskirts of their towns.
6 And the towns which you give the Levites are to be the six safe places to which the taker of life may go in flight; and in addition you are to give them forty-two towns.
7 Forty-eight towns are to be given to the Levites, all with land round them.
8 And these towns are to be given out of the heritage of the children of Israel, taking the greater number from those who have much, and a smaller number from those who have little: everyone, in the measure of his heritage, is to give of his property to the Levites.
9 And the Lord said to Moses,
10 Say to the children of Israel, when you have gone over Jordan into the land of Canaan;
11 Then let certain towns be marked out as safe places to which anyone who takes the life of another in error may go in flight.
12 In these towns you may be safe from him who has the right of punishment; so that death may not overtake the taker of life till he has been judged by the meeting of the people.
13 Six of the towns which you give will be such safe places;
14 Three on the other side of Jordan and three in the land of Canaan, to be safe places for flight.
15 For the children of Israel and for the man from another country who is living among them, these six towns are to be safe places, where anyone causing the death of another through error may go in flight.
16 But if a man gives another man a blow with an iron instrument, causing his death, he is a taker of life and is certainly to be put to death.
17 Or if he gives him a blow with a stone in his hand, causing his death, he is a taker of life and is certainly to be put to death.
18 Or if he gave him blows with a wood instrument in his hands, causing his death, he is a taker of life and is certainly to be put to death.
19 He whose right it is to give punishment for blood, may himself put to death the taker of life when he comes face to face with him.
20 If in his hate he put a sword through him, or waiting secretly for him sent a spear or stone at him, causing his death;
21 Or in hate gave him blows with his hand, causing death; he who gave the death-blow is to be put to death; he is a taker of life: he whose right it is to give punishment for blood may put to death the taker of life when he comes face to face with him.
22 But if a man has given a wound to another suddenly and not in hate, or without design has sent something against him,
23 Or has given him a blow with a stone, without seeing him, so causing his death, though he had nothing against him and no desire to do him evil:
24 Then let the meeting of the people be judge between the man responsible for the death and him who has the right of punishment for blood, acting by these rules:
25 And let the people keep the man responsible for the death safe from the hands of him who has the right of punishment for blood, and send him back to his safe town where he had gone in flight: there let him be till the death of the high priest who was marked with the holy oil.
26 But if ever he goes outside the walls of the safe town where he had gone in flight,
27 And the giver of punishment, meeting him outside the walls of the town, puts him to death, he will not be responsible for his blood:
28 Because he had been ordered to keep inside the safe town till the death of the high priest: but after the death of the high priest the taker of life may come back to the place of his heritage.
29 These rules are to be your guide in judging through all your generations wherever you may be living.
30 Anyone causing the death of another is himself to be put to death on the word of witnesses: but the word of one witness is not enough.
31 Further, no price may be given for the life of one who has taken life and whose right reward is death: he is certainly to be put to death.
32 And no price may be offered for one who has gone in flight to a safe town, for the purpose of letting him come back to his place before the death of the high priest.
33 So do not make the land where you are living unholy: for blood makes the land unholy: and there is no way of making the land free from the blood which has come on it, but only by the death of him who was the cause of it.
34 Do not make unclean the land where you are living and in which is my House: for I the Lord am present among the children of Israel.

CHAPTER 35
Nu 35:1-5. Eight and Forty Cities Given to the Levites.
2. give unto the Levites of the inheritance of their possession cities to dwell in—As the Levites were to have no territorial domain allocated to them like the other tribes on the conquest of Canaan, they were to be distributed throughout the land in certain cities appropriated to their use; and these cities were to be surrounded by extensive suburbs. There is an apparent discrepancy between Nu 35:4 and Nu 35:5, with regard to the extent of these suburbs; but the statements in the two verses refer to totally different things—the one to the extent of the suburbs from the walls of the city, the other to the space of two thousand cubits from their extremity. In point of fact, there was an extent of ground, amounting to three thousand cubits, measured from the wall of the city. One thousand were most probably occupied with outhouses for the accommodation of shepherds and other servants, with gardens, vineyards, or oliveyards. And these which were portioned out to different families (1Ch 6:60) might be sold by one Levite to another, but not to any individual of another tribe (Jer 32:7). The other two thousand cubits remained a common for the pasturing of cattle (Le 25:34) and, considering their number, that space would be fully required.
Nu 35:6-8. Cities of Refuge.
6. there shall be six cities for refuge, which ye shall appoint for the manslayer—The establishment of those privileged sanctuaries among the cities of the Levites is probably traceable to the idea, that they would be the most suitable and impartial judges—that their presence and counsels might calm or restrain the stormy passions of the blood avenger—and that, from their being invested with the sacred character, they might be types of Christ, in whom sinners find a refuge from the destroyer (see De 4:43; Jos 20:8).
8. the cities which ye shall give shall be of the possession of the children of Israel—The burden of furnishing those places for the residence and support of the Levitical order was to fall in equitable proportions upon the different tribes (see Nu 33:54; Jos 20:7).
Nu 35:9-34. The Blood Avenger.
11. that the slayer may flee thither, which killeth any person at unawares—The practice of Goelism, that is, of the nearest relation of an individual who was killed being bound to demand satisfaction from the author of his death, existed from a very remote antiquity (Ge 4:14; 27:45). It seems to have been an established usage in the age of Moses; and although in a rude and imperfect state of society, it is a natural and intelligible principle of criminal jurisprudence, it is liable to many great abuses; the chief of the evils inseparable from it is that the kinsman, who is bound in duty and honor to execute justice, will often be precipitate—little disposed, in the heat of passion or under the impulse of revenge, to examine into the circumstances of the case, to discriminate between the premeditated purpose of the assassin and the misfortune of the unintentional homicide. Moreover, it had a tendency, not only to foster a vindictive spirit, but in case of the Goel being unsuccessful in finding his victim, to transmit animosities and feuds against his descendants from one generation to another. This is exemplified among the Arabs in the present day. Should an Arab of one tribe happen to kill one of another tribe, there is "blood" between the tribes, and the stain can only be wiped out by the death of some individual of the tribe with which the offense originated. Sometimes the penalty is commuted by the payment of a stipulated number of sheep or camels. But such an equivalent, though offered, is as often refused, and blood has to be repaid only by blood. This practice of Goelism obtained among the Hebrews to such an extent that it was not perhaps expedient to abolish it; and Moses, while sanctioning its continuance, was directed, by divine authority, to make some special regulations, which tended both to prevent the unhappy consequences of sudden and personal vengeance, and, at the same time, to afford an accused person time and means of proving his innocence. This was the humane and equitable end contemplated in the institution of cities of refuge. There were to be six of these legalized asyla, three on the east of Jordan, both because the territory there was equal in length, though not in breadth, to Canaan, and because it might be more convenient for some to take refuge across the border. They were appointed for the benefit, not of the native Israelites only, but of all resident strangers.
16-21. If he smite him with an instrument of iron, so that he die, &c.—Various cases are here enumerated in which the Goel or avenger was at liberty to take the life of the murderer; and every one of them proves a premeditated purpose.
22-28. But if he thrust him suddenly without enmity, or have cast upon him any thing without laying of wait, &c.—Under the excitement of a sudden provocation, or violent passion, an injury might be inflicted issuing in death; and for a person who had thus undesignedly committed slaughter, the Levitical cities offered the benefit of full protection. Once having reached the nearest, for one or other of them was within a day's journey of all parts of the land, he was secure. But he had to "abide in it." His confinement within its walls was a wise and salutary rule, designed to show the sanctity of human blood in God's sight, as well as to protect the manslayer himself, whose presence and intercourse in society might have provoked the passions of the deceased's relatives. But the period of his release from this confinement was not until the death of the high priest. That was a season of public affliction, when private sorrows were sunk or overlooked under a sense of the national calamity, and when the death of so eminent a servant of God naturally led all to serious consideration about their own mortality. The moment, however, that the refugee broke through the restraints of his confinement and ventured beyond the precincts of the asylum, he forfeited the privilege, and, if he was discovered by his pursuer, he might be slain with impunity.
29-34. these things shall be for a statute of judgment unto you throughout your generations—The law of the blood-avenger, as thus established by divine authority, was a vast improvement on the ancient practice of Goelism. By the appointment of cities of refuge, the manslayer was saved, in the meantime, from the blind and impetuous fury of vindictive relatives; but he might be tried by the local court, and, if proved guilty on sufficient evidence, condemned and punished as a murderer, without the possibility of deliverance by any pecuniary satisfaction. The enactment of Moses, which was an adaptation to the character and usages of the Hebrew people, secured the double advantage of promoting the ends both of humanity and of justice.
